What is “Ban the Box”?

The term “Ban the Box” is becoming more common. Many people want to know what this actually means. “Ban the Box” is a term used for employers to remove the criminal conviction questions from the job application process. You know, the one that says:

“Have you ever been convicted of a crime?” Yes or No – If you checked yes, please explain

We have all had to complete an application and answer this question. For many this is the question that keeps them from applying, they are certain it will mean having their application thrown out without ever being considered. It is reported that appox. 70 million Americans (1 in 4) have a criminal record, many of these criminal records are for petty crimes, non-violent crimes, one mistake as a young adult, one mistake as an older adult, and so on. This type of criminal record often times does not give an applicant the opportunity to display their knowledge or skills before their application is dismissed. Employers are also encouraged to have a policy in place that takes into account the offense, length of time since conviction, and other variables surrounding the type of job and circumstances rather than simply stating, “We do not hire persons with a criminal record”.

“Ban the Box” gained ground and became more popular throughout the 90’s and continues to pick up steam today. Many advocates say “Ban the Box” is a must due to the tough laws on petty drug crimes, the rise in unemployment, and background checks being more accessible than ever. As of 2014 there are 13 States and 52+ cities that have adopted “Ban the Box” Legislation. Target was one of the major companies that “Banned the Box” in 2013. Some states mandate Ban the Box statewide, other states may only have certain areas this applies, for example, in the state of Texas ban the box legislation has only been passed in Austin, and Travis County.

We all know individuals who make a mistake and pay for it the rest of their life, every time they rent or apply for a job this will be an issue. As more states adopt this type of legislation it may soon be a more even playing field for the ones who have a record, and the ones who didn’t get caught.
